Both of these unsubstantiated accusations have been spreading like wildfire over the last week. Depp sued the publisher of the Sun, News Group Newspapers, in June 2018 after the newspaper published allegations that he was a “wife-beater,” for those of you who aren’t familiar with their story. Later that year, Heard wrote an op-ed in the Washington Post regarding sexual violence (Depp was not addressed).
A London court determined in November 2020 that the majority of Depp’s claimed assaults against Heard were “proven to a civil standard,” and hence Depp lost his libel case against the Sun (on the balance of probabilities). As a result of her op-ed in the Washington Post, he is now suing Heard for defamation.
As a result, the internet has gone berserk. Funny how a slander trial can bring out the worst in people. Courtroom cameras have turned a complicated, personal matter into a spectator event because of the constant rolling of the cameras. There have been countless clips of the trial repeated on social media for a snarling audience. When it comes to Johnny Depp and Amber Heard, social media users are saying whatever they want about them.
When a recent audiotape of Heard testifying about her alleged sexual assault by Johnny Depp was played on TikTok, individuals made aroused facial expressions (the audio clip has since been removed from the site). TikTok appeared to be pantomime performers mimicking Heard’s claim of abuse, twisting and turning to bring out alleged contradictions.
Whether or not one accepts Heard’s testimony, it is important to remember that downplaying or mocking abuse is never a good idea. With more than 277,000 views on YouTube, “Woodworker Attorney DEBUNKS Amber Heard’s “Broken Bed” Testimony!” is the most popular YouTube video on the subject. Unsubstantiated assertions have been repeated in uncritical stories with headings such as “Viewers observe…” and “People are stating…”.”
Is it too much to expect that we approach this somber subject with a somber attitude? The fact that we don’t turn a serious and sensitive trial into something we can use in our feeds? It would be fantastic if all celebrity court cases were covered in a courteous and dignified manner. Fans of a celebrity who are accused of sexual assault with a liquor bottle will be forced to put their hero worship on hold while the case is being heard by an impartial jury.
It’s a shame that fandom hasn’t drawn the line at the courthouse door, because we’re all poorer for it. Depp’s car windows were smashed by screaming fans as he left the courthouse in Virginia. When it comes to a trial, it should never be a concert or meet-and-greet, or an opportunity to show off your homemade sign to a star.
When it comes to celebrity trials, fans need to be aware that their behavior is being scrutinized. Social media users can theoretically be prosecuted for libel for what they post (though in practice, the cases we read about involve tweets from those with high public profiles, such as TV doctors, rightwing provocateurs, and comedians).
In the absence of a lawsuit, people should be significantly more cautious about what they write online. Even if fans are convinced that their heroes are innocent, it is important to treat all allegations carefully. It’s not appropriate to turn abuse stories into lighthearted farces. As a result, we run the risk of establishing a world where people look to TikTok videos instead of courts to determine the truth.
