In relation to the untimely death of a patient in 2018, Dr. Carlos Chacon, a plastic surgeon in the San Diego area, of Divino Plastic Surgery in Bonita, California, has been charged with second-degree murder. In addition, Dr. Chacon is the target of multiple civil cases from patients who claim to have had surgical errors. Dr. Chacon Has Pleaded Not Guilty to Criminal Accusations
In response to allegations related to Megan Espinoza’s death, Dr. Chacon pleaded not guilty in April 2023. Sadly, Megan died a few days after going into cardiac arrest after her breast augmentation procedure.
Regarding Espinoza’s passing, Dr. Chacon was first accused of involuntary manslaughter. The San Diego Union-Tribune stated that the allegation was increased to second-degree murder after an investigation revealed that Dr. Chacon reportedly neglected to call 911 for three hours and even attended to other possible patients while Espinoza was in agony.
Deputy District Attorney Gina Darvas from San Diego County claims that Dr. Chacon stopped others at Divino Plastic Surgery from calling for emergency help.
After Dr. Chacon’s arraignment on April 10, Darvas told KGTV reporters, “The defendant essentially doubled down on his practices and prevented other people from calling 911 and allowed Ms. Espinoza to essentially suffocate for a three-hour period before emergency personnel were finally summoned.”
Prosecutors added the second-degree allegation because of Dr. Chacon’s alleged “conscious disregard for life.”
A Divino Plastic Surgery Nurse is Also Facing Charges
In relation to Espinoza’s death, Heather Lang Vass, a registered nurse who supported Dr. Chacon throughout the procedure, has also been charged. In May 2023, she entered a guilty plea to involuntary manslaughter.
In contrast to a certified anesthesiologist, Espinoza received anesthesia from a nurse before her surgery, per a 2022 report from the Medical Board of California (MBA) that was referenced by KGTV. After the surgery lasted for two hours, Espinoza experienced cardiac arrest. Rather than dialing 911 right away, Dr. Chacon consulted with two anesthesiologists, one of whom advised him to “immediately call 911,” as stated in the report.
Unfortunately, it was reported that Dr. Chacon did not call emergency assistance for three hours. Espinoza was pronounced brain dead when she got to the hospital, and five days later she passed away.
Civil Lawsuits Filed Against Divino Plastic Surgery
The family of Espinoza filed a civil complaint against Divino Plastic Surgery and Dr. Chacon. The family came to an undisclosed deal in December 2022.
Natassia Louis, a different former patient of Dr. Chacon, filed a complaint claiming the surgeon performed her surgery incorrectly, causing a perforation in her stomach. Louis had gone to Divino Plastic Surgery for a buttock lift, but Dr. Chacon persuaded her to get a “full mommy makeover,” which included a breast lift and fat transfer from her stomach to her buttocks.

On April 6, 2021, not long after her surgery, Louis allegedly suffered a gastrointestinal puncture. Dr. Chacon consented to execute a repair, but before Louis agreed to any more surgeries, someone in his office suggested that he look up the doctor online.
Louis emphasized her dismay, saying, “He shouldn’t be in business right now. No one stopped him after things started happening. No one stopped him, and he continues to be in business, and he continues to hurt people, and it could have been stopped.”
