On Thursday, the surviving partner of a Capitol Police officer who died in the attack on January 6 filed a lawsuit against former President Donald J. Trump and two Capitol rioters, claiming that the officer’s death was a “direct and foreseeable consequence” of Trump’s and the rioters’ actions.
Almost two years after Officer Brian D. Sicknick was attacked with chemical spray on January 6, a lawsuit was filed in Federal District Court for the District of Columbia seeking at least $10 million in damages from Mr. Trump and two men, George Tanios and Julian Elie Khater. Mr. Tanios pled guilty to minor counts, while Mr. Khater pleaded guilty to assault.
“The horrific events of Jan. 6, 2021, including Officer Sicknick’s tragic, wrongful death, were a direct and foreseeable consequence of the defendant’s unlawful actions,” the suit said, adding that “the defendants are responsible for the injury and destruction that followed.”
Even though Officer Sicknick passed dead the day after the mob clash, prosecutors did not press charges because the Washington medical examiner found that his death was due to natural causes (several strokes that happened hours after the mob confrontation). However, “everything that happened had a factor in his condition,” per the medical examiner, therefore the Capitol Police are calling his death a “line of duty” tragedy.

Sandra Garza, Officer Sicknick’s lifelong companion, and the estate’s agent filed suit against the president, alleging that he was responsible for the violence on January 6 and especially for Sicknick’s murder. According to the complaint, the House committee that looked into the attack on January 6 “made a number of criminal referrals” against Mr. Trump “based on its finding of sufficient evidence of one or more potential violations,'” the complaint said, adding that this “included inciting an insurrection.”
A representative for Mr. Trump said the complaint is baseless in an early Friday statement. Several lawsuits have been filed against the ex-president, alleging that he is financially responsible for the aftermath of the January 6 assault. In February, a federal court ruled to allow three legal complaints against Mr. Trump to proceed. A legal challenge to the ruling is being prepared.

One year after the attack on the Capitol on January 6, Officer Sicknick was one of five police officers to lose their lives. Suicide was the cause of death for the other four policemen; their names were Jeffrey Smith, Howard S. Liebengood, Gunther Hashida, and Kyle DeFreytag.
